Terms Of Use

1. Introduction

Welcome to miSocial, operated by skunkworx ("we", "us", "our"). These Terms of Use govern your access to and use of miSocial, including the apps, games, content, memberships and other features offered on the platform. By creating an account or using the platform, you agree to these Terms of Use and to our Privacy Policy.

If you do not agree to these terms, please do not use the platform.

2. Eligibility

You must be at least 16 years old to create an account on miSocial.

You must be 18 or older to buy or use a paid membership (such as Premium or Elite) and to view sensitive content.

By using the platform, you confirm that you meet these age requirements and that the information you provide about yourself, including your date of birth, is accurate. We may suspend or close any account that gives a false date of birth or belongs to someone under the minimum age.

3. Your Account

You can sign up with an email address and password, or through a supported sign-in provider such as Google. You agree to keep your account information accurate and up to date, to keep your password private, and to use only one personal account. You are responsible for everything that happens under your account.

Please tell us right away at privacy@misocial.net if you think someone else has used your account.

4. Your Content

You can post and share content on miSocial, including posts, comments, photos, videos, messages, stories and other material ("Your Content"). You keep ownership of Your Content. By posting it, you give miSocial a worldwide, royalty-free, non-exclusive licence to host, store, display, reproduce and distribute Your Content, and to resize or reformat it, only as needed to run, show and improve the platform. This licence ends when you delete Your Content or your account, except for copies other members have already shared or that we must keep by law.

Depending on your settings and where you post, Your Content may be visible to your friends, to other members or to the public.

You are responsible for Your Content and you must have the right to post it. You agree not to post content that:

  • Infringes anyone's copyright, trademark or other rights.
  • Shows or sexualizes anyone under 18, in any way.
  • Shows another person in an intimate or sexual way without their consent.
  • Is hateful, threatening, harassing or defamatory.
  • Contains adult content outside the areas of the platform marked as sensitive content, or without marking it as sensitive where the platform asks you to.
  • Breaks any law, or contains viruses, malware or other harmful code.

We may remove any content that breaks these terms, and we may report illegal content to the authorities.

5. Prohibited Conduct

While using the platform, you agree not to:

  • Harass, bully, threaten, stalk or abuse other members.
  • Impersonate any person or entity, or create fake or misleading profiles.
  • Send spam, scams or unwanted commercial messages.
  • Use the platform for any unlawful or fraudulent purpose.
  • Scrape, copy or collect other members' data or content without permission.
  • Use bots, scripts, multiple accounts or exploits to cheat in games, ratings, votes or rewards.
  • Interfere with, overload or try to break the security of the platform.

6. Memberships, Credits and Payments

Some features are only available with a paid membership (such as Premium or Elite) or by using credits. Prices are shown before you pay. Payments are handled by our third-party payment processors; we do not store your full card number.

  • Renewal: Memberships renew automatically at the end of each billing period, at the price shown when you signed up, until you cancel.
  • Cancelling: You can cancel at any time. Your membership stays active until the end of the period you have already paid for, and will not renew after that.
  • No refunds: Payments for memberships and credits are non-refundable, including for partly used periods or unused credits, except where the law requires a refund.
  • Credits: Credits have no cash value, cannot be exchanged for money and cannot be transferred to other accounts. Credits are lost if your account is closed for breaking these terms.
  • Price changes: We may change prices. A price change will not affect a period you have already paid for.

7. Third-Party Services

The platform may link to, embed or rely on services run by others, such as sign-in providers, payment processors and video sites. Your use of those services is governed by their own terms, and we are not responsible for them.

8. Ending Your Account

You can stop using the platform at any time, and you can ask us to delete your account by emailing privacy@misocial.net.

We may suspend or close your account, or remove access to any feature, if you break these terms, if we are required to by law, or if we believe your use of the platform could harm other members or the platform. When an account is closed, you may lose access to Your Content and any unused credits or remaining membership time.

9. Disclaimers

The platform is provided "as is" and "as available", without warranties of any kind, express or implied. We do not promise that the platform will always be available, error-free or free of harmful components. Content posted by members is their own; we do not check it in advance or vouch for it. 10. Limitation of Liability

To the fullest extent allowed by law, skunkworx and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, profits or goodwill, arising from your use of the platform.

To the fullest extent allowed by law, our total liability to you for any claim relating to the platform is limited to the amount you paid us in the 12 months before the claim arose.

11. Indemnification

You agree to cover skunkworx and its owners, employees and partners against any claims, damages or costs (including reasonable legal fees) that arise from Your Content or from your breaking these Terms of Use.

12. Governing Law

These Terms of Use are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Any dispute relating to these terms or the platform will be handled by the courts of British Columbia, Canada.

13. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will post the new version on this page and change the effective date above. If a change is significant, we will let you know on the platform or by email. If you keep using the platform after a change takes effect, you accept the updated terms.
